A Yard Sale Application is required to conduct a yard sale within the Town of Nashville. 

YARD SALE APPLICATION 

  

YARD SALE PROCESS: 

STEP 1: APPLICATION & FEE

Application is available online and at Town Hall.

The Yard Sale application fee is $5 (for the first permit issued; $10 thereafter) and is due prior to issuance of permit. 

STEP 2: APPLICATION & SITE PLAN SUBMITTAL

Application must be completed and can be submitted in-person or emailed to permits@townofnashvillenc.gov .

Incomplete applications WILL NOT be processed. 

STEP 3: PLANNING STAFF REVIEW

Staff will review yard sale application to ensure compliance of the Code of Ordinances. 

Yard sale regulations, per Town of Nashville’s Code of Ordinances are as follows: 

Sec. 28-36. - Regulation of yard sales.

(a) Generally.

(1) It shall be unlawful for any individual, group, or corporation to conduct within the town a yard sale or permit a yard sale to be held within the town on residential property under the individual, group, or corporation's control without first obtaining a yard sale permit from the town.

(2) Yard sale permits are site/residence specific;

(b) Frequency and duration limitations.

(1) Four yard sales are permissible per household in any 12-month period;

(2) The maximum duration of any yard sale shall be two consecutive calendar days;

(3) The approved yard sale must be held within 15 days of the issuance of the permit for that yard sale.

(c) Fee for permit.

(1) The fee for the first permit issued to a household within any 12-month period shall be $5.00. 

(2) The fee for the second permit issued to a household within the same 12-month period as the first permit shall be $10.00.

(3) All permit fees shall be paid to the planning director or his designee prior to issuance of the permit.

(4) Nonprofit service organizations and charitable organizations may obtain up to four yard sale permits in any 12-month period without payment of fee.

(d)  Violation. Any person who shall violate any provision of this section shall be cited with a civil code violation and pay a fine of $25.00 for the first offense; $50.00 for the second offense; $75.00 for the third offense; and any offense thereafter shall be collected as unpaid taxes.

(e)  Enforcement. Any police officer of the town is hereby authorized to act on behalf of the town in the enforcement of this section.

Sec. 18-137. General provisions.

(n). Temporary and portable signs.  

(10) Yard sale signs are only allowed to be erected after 4:00 p.m. on the day before the event or sale. The signs are not permitted to be placed on any public sign pole, telephone pole, power pole, or within the public right-of-way. The signs must be removed by 4:00 p.m. on the day of the event.

STEP 4: APPROVAL AND PAYMENT 

Once yard sale application is approved, applicant is responsible for making the appropriate payment.

Yard Sale Certificate of Compliance is signed by both applicant and Planning staff. 

Planning staff will make appropriate copies of the approved yard sale packet.
